Information We Collect About You and How We Collect It
Personal Information We Collect – Generally
We may collect several types of information from and about individuals, including users of our Website. This information may include information by which individuals can be personally identified or other information about an individual that is maintained in personally-identifiable form (collectively, “Personal Information”). Specifically, we (or our third-party service providers acting on our behalf) may collect the following:

Personal Information We Collect – Submitting Job Applications Through the Website
If you submit a job application through our Website or otherwise (“Job Applicant”), we (or our third-party service providers acting on our behalf) may also collect the following:
- Your employment and educational background, history, skills, and experience, including a copy of your resume and any cover letter, work sample, transcript, certifications, or other documentation you choose to submit in connection with your application.
- On an entirely voluntary, optional basis should you choose to provide it (as described in detail in the job application submission form), demographic survey information such as your gender and/or pronouns, racial or ethnic origin, protected veteran status, and disability status.
- Your work authorization information, which may include your citizenship or immigration status.
- Information about your interest in the job for which you are applying and your relationship to any of our current employees.
- Any other information you choose to submit in connection with your job application.
Sensitive Personal Information
As noted above, certain Personal Information collected from and about Job Applicants may include several types of information that fall within the definition of “sensitive personal information” or similar terms or concepts under applicable data privacy laws (collectively, “Sensitive Personal Information”). If we collect any Sensitive Personal Information about you in your capacity as a Job Applicant, we will use such information on a limited basis only (i) as necessary to perform services or provide products reasonably expected by an average person who requests those products or services from us; (ii) for purposes of helping to ensure security and integrity to the extent the use of such Sensitive Personal Information is reasonably necessary and proportionate for these purposes; (iii) for short-term, transient use, including but not limited to non-personalized advertising shown as part of your current interaction with us, provided that the Sensitive Personal Information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside your current interaction with us; (iv) as a service provider to another business performing services on behalf of that business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business; (v) for purposes of undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us; or (vi) as otherwise permitted by applicable law and regulations.
How We Collect Information
With the exception of your Technical Information and Internet Activity (which we or our third-party services providers collect automatically as you navigate through or interact with our Website, as described below in the section titled “Traffic, Usage, and Computer/Device Information”) and your Inference Data (which is derived from the other information collected about you, as described above), we primarily collect information, including Personal Information, directly from you when you provide it or submit it to us, including in connection with creating an account on our Website, completing a purchase of our products or services, signing up to obtain additional information from us (such as by signing up to receive our periodic e-mails, text messages, newsletters, or other informational and promotional information about our or third parties’ products and services), entering into a sweepstakes, contest, giveaway, or other promotion related to our products or services, corresponding with us via postal mail, e-mail, text message, telephone, or through our Website, requesting additional services from us (such as customer support services), submitting a job application through our Website, leaving a review of our products or services through our Website, completing and submitting forms through our Website, reporting a problem with our Website or our products or services, submitting an inquiry to us using the contact methods provided on our Website, or otherwise contacting us about our Website, our products or services, or our business.
Traffic, Usage, and Computer/Device Information
Additionally, as you navigate through and interact with our Website or interact with the e-mails and other electronic messages we send to you, we or our third-party service providers may automatically collect certain traffic data, usage information, and information about your computer equipment or mobile device, such as your browser and operating system, your wireless carrier, the geographic region from which you are accessing the Website, time-stamped logs regarding access times and duration of visits, the pages of our Website that you visit, whether you opened the e-mail message we sent to you and whether you clicked on any links in the message, configuration data, clickstream analytics, and your actions and patterns when you use our Website or interact with our electronic messages (“Technical Information”). The technologies we use for this automatic data collection may include cookies that are stored on the browser of your computer or mobile device, small embedded electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) and other types of embedded code. In addition to the Technical Information described above, we may also collect your e-mail address via cookies, pixel tags, and other types of embedded code, including through any such code provided by trusted third-party partners. These partners may combine your e-mail address with other information they maintain (such as your mailing address) so that we may serve relevant marketing offers to you via direct mail. How We Use Your Information
Generally
We may use the information we collect about you or that you provide to us, including Personal Information, to:

Aggregated or De-Identified Data
We may convert or combine some Personal Information of users into de-identified or aggregated data that does not disclose any of the Personal Information of any individual user. We will not attempt to re-identify any de-identified data. To the extent that we have disclosed de-identified or aggregated data to third parties, we will exercise reasonable oversight to monitor compliance with any contractual commitments to which the de-identified data is subject and take appropriate steps to addresses any breaches of such contractual commitments.
Text Message Program
You may be given the option to register to receive SMS text messages from us in connection with your use of the Website (the “Text Message Program”). We provide the Text Message Program to send you (1) informational and transactional communications relating to your use of the Website, such as status updates about orders placed and order fulfilment, and (2) Website-related marketing, advertising, and promotional communications, such as special offers, discounts, or promotions relating to your use of the Website. You may opt out of receiving additional texts by following the applicable instructions in the section titled “Your Rights and Choices – Generally.”
Tracking and “DO NOT TRACK”
Tracking involves the use of cookies, web beacons, or other embedded code or tracking technologies to collect, analyze, and store information on a user’s behavior over time on multiple sites, including information on the sites visited, products viewed, products purchased, and other online interactions. Tracking information can be used to enable companies to make interest-based (behavioral) advertising available to users on multiple sites that they visit.
We may collect Personal Information about your online activities over time and across third-party sites for tracking purposes when you use our Website. However, we do not currently allow third parties to collect Personal Information through or using our Website that could be used by them to analyze and store information about your online activities over time and across third-party sites for their own tracking purposes (separate and apart from any services they provide to us in support of our permitted uses of your Personal Information as described in this Policy).
Our Website does not respond to any “do not track” signals sent by your computer, browser, or mobile device, and if your computer, browser or mobile device sends a “do not track” signal to our Website, our Website will not treat you differently from users who do not send such signals. Use of Google Analytics
We use Google Analytics and certain products marketed by Google through its YouTube business to track and analyze certain traffic and usage statistics regarding the use of our Website, such as the number of visitors to our Website, how visitors are navigating to our Website, visitors’ general geographic region information, how long individuals are visiting our Website, and information about the equipment individuals are using to access our Website (e.g., browser version and operating system). Google Analytics may use a Google Analytics cookie as part of this service, and we may share certain Personal Information with Google Analytics as part of this service. We use this traffic and usage information to gauge, internally, the effectiveness of our advertising efforts and to make improvements to our Website and our marketing and promotional efforts.

Use of Meta Business Tools
We may use various advertising services and business tools provided by Meta (operator of the Facebook and Instagram social media platforms) in connection with our Website. The services and tools we may use are summarized here: https://www.facebook.com/legal/terms/businesstools.
In connection with our use of these services and tools, Meta may use cookies, web beacons, and other storage technologies to collect or receive information from the Website and elsewhere on the Internet and use that information to provide measurement services and target ads to you and others. These technologies may include, but are not limited to, Meta Pixel, Conversions API, App Events via Facebook SDK, Offline Conversions, and App Events API. These services help us (1) measure and track the results of our advertising on Facebook, and (2) better target our advertisements on Facebook and Instagram to new potential users. In connection with this service we may provide your e-mail address to Meta along with the e-mail addresses of our other users, and Meta may use this information to find other users of its Facebook and Instagram platforms with similar demographics and interests as indicated in the profiles and activities on Facebook of our users generally, to help us better target our advertising efforts on Facebook and Instagram to those other users.

Because those opt-outs, preference control pages, and privacy settings are specific to the individual browser used to visit them or the individual Facebook or Instagram profile, and because those opt-outs, preference control pages, and privacy settings are not operated or controlled by us, we are unable to perform the opt-outs, set your preferences, or adjust the privacy settings on your behalf.
Use of Hot Jar
We may use services provided by Hotjar Ltd. to better understand our users’ needs and to optimize our Website and user experience. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular, device IP addresses (captured and stored only in anonymized form), device screen size, device type, certain unique device identifiers, browser information, geographic location (country only), and preferred language used to display our Website). This information helps us create a better experience for our site users. Hotjar stores this information on our behalf in a pseudonymized user profile. Use of Shopify Enhanced Services
We may use Shopify’s Enhanced Services offering on our Website in connection with our use of storefront hosting services provided by Shopify, and Shopify may collect and process your Personal Information to provide advanced product and store customization, analytics, and advertising services to us. Use of Pinterest Advertising Services
We may use certain Ad Services features provided by Pinterest (including the Pinterest Ad Service Tag), for various purposes, including matching Website visitors to corresponding Pinterest accounts and to create targeted audiences of Website visitors for behavioral advertising purposes. You may opt out of receiving behavioral advertisements generated in connection with our use of Pinterest Ad Servies by adjusting the privacy and data settings within your Pinterest account.
Disclosure of Your Information
Generally
We may disclose Personal Information to any contractors and other service providers who need to know such information to provide services to us that support our hosting, maintenance, operation, and promotion of our Website, our supply of products and services, and our other permitted uses of Personal Information under this Policy. In particular, we may disclose your Personal Information as follows:
- We may use a third-party cloud-hosting infrastructure provider (e.g., Amazon Web Services, Google Cloud, or Microsoft Azure) to store certain portions of your Personal Information securely.

- We may use a recruiting portal to collect and process applications for employment with us (as described above in the section titled “Personal Information We Collect – Submitting Job Applications Through the Website”).
- We may use an integrated chat feature to provide customer service to users of our Website.
- We may use one or more payment processors, payments gateways, and online checkout integrations to securely process customer payments and orders.
- We may use third-party e-mail or text messaging platforms to communicate with you regarding your orders and our products and services.

No Sales of Personal Information
We do not sell, and in the past 12 months we have not sold, any Personal Information to third parties.
Retention of Your Information
We will retain your Personal Information for no longer than is reasonably necessary to achieve the legitimate business purposes or uses stated in this Policy, unless a longer retention period is required or allowed by applicable law or to otherwise fulfill a legal requirement. We use the following criteria to determine the applicable period to retain your Personal Information:

Your Rights and Choices
Generally
You have certain choices regarding the Personal Information you provide to us. You can set your browser to refuse all or some browser cookies. If you choose not to accept cookies, you may be unable to access certain parts or pages of our Website, or certain parts or features of our Website may not function properly. Please see the section above titled “Tracking and ‘DO NOT TRACK’” for more information regarding how to opt out of cookies and similar tracking technologies used in connection with our Website.
If you do not wish to have your Personal Information used by us to contact you for marketing or promotional purposes, you may send us an e-mail with your request to care@eastfork.com, or you can opt out by clicking on the “Unsubscribe” or similar link in the most recent e-mail you received from us and by following the prompts that appear. This opt-out does not apply to information provided as a result of a product purchase, customer service or support service inquiry, or other transactional communications (e.g., an order confirmation or response to a specific inquiry or request you have made to us).
If you have enrolled in our Text Message Program, you may opt out of this service (i.e., stop all text messages) at any time. With respect to any text message, you may reply STOP to end all messages, or you may opt out by contacting us via e-mail at care@eastfork.com. In each case, please allow us a few days to process your opt-out request.
If you’d like to opt out of receiving direct mail from us (like catalogs or postcards), please fill out this form. Please allow us a reasonable time to process your request.
Accessing, Correcting, or Deleting Your Information: Generally
You can review, change, and request the deletion of certain portion of your Personal Information collected or processed by us under this Policy in accordance with the laws of certain U.S. states (such as the California Consumer Privacy Act of 2018 (as amended to date, the “CCPA”)), as applicable, the laws of certain countries outside the U.S., as applicable, and the following:
- You may request that we confirm whether we have processed your Personal Information and disclose to you certain information about the Personal Information about you that we have collected and used, including by receiving a portable and, to the extent technically feasible, readily usable copy of your Personal Information (collectively, a “Request to Know”). As part of your Request to Know, you may also request that we provide a list of the categories of third parties to which we have disclosed your Personal Information. You may also request that we correct, update, or modify the Personal Information about you that we have collected or that we maintain (a “Request to Correct”). Further, you may request that we delete the Personal Information about you that we have collected or that we maintain (a “Request to Delete”). You may submit a Request to Know, Request to Correct, or a Request to Delete by sending us an e-mail stating your request to care@eastfork.com or by calling us at 828-237-7200. Regardless of the method you use to contact us, please indicate in your communication that you are making a Request to Know, Request to Correct, or a Request to Delete (as applicable) under our Privacy Policy.
- Upon receipt of your Request to Know, Request to Correct, or Request to Delete, as part of our security measures and as required by law, we will take steps to verify your identity in order to confirm that the person making the request is actually the person about whom we have collected Personal Information (i.e., that the “you” making the request is actually you). We will verify your identity and confirm your request by asking you to confirm and verify certain Personal Information we already have on file for you. For example:
- If you have purchased a product through our Website or if you have registered for an account on our Website, we may verify your request by asking you to (1) send an e-mail to care@eastfork.com using the e-mail address we have on file for your account, and (2) in that e-mail, verify at least one other item of Personal Information we have on file for your account. We will provide our specific request at the time we provide an initial response to your Request to Know, Request to Correct, or Request to Delete.
- If you have not purchased a product through our Website or registered for an account on our Website, please note that we likely have only limited information about you. You will be required to verify your request by confirming and verifying certain Personal Information we have on file for you.
- We will use reasonable endeavors to accommodate verifiable Requests to Know, Requests to Correct, and Requests to Delete submitted in the manner described above within a reasonable timeframe after receiving such requests. In response to your appeal, we will inform you within the time period required by applicable law of any action we have or have not taken in response to your appeal and provide a written explanation of our reasoning for such decision. To the extent required by applicable law, if your appeal is denied we will provide you with a method through which you may contact your state’s attorney general or equivalent agency to submit a complaint regarding the denial of your Request to Know, Request to Correct, or Request to Delete.
No Differential Treatment or Retaliation
If you choose to exercise any of the rights described in the section titled “Accessing, Correcting, or Deleting Your Information: Generally”, you will not receive differential treatment by us as a result (e.g., different prices or quality of products or services, or different treatment in connection with your employment with us, your application for employment with us, or your engagement with us as an independent contractor), except to the extent that such information was provided in connection with a Financial Incentive (as described in the section below titled “Notice of Financial Incentives”) or as otherwise permitted by applicable law.
Opt Out of Data Sharing / Targeted Advertising

C. Transfers of Your E.U. Personal Information to the United States

You will not usually have to pay a fee to exercise any of your European Privacy Rights. We may, however, charge a reasonable fee if a request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in those circumstances.
We may need to request specific information from you to help us confirm your identity and to validate your right to exercise your European Privacy Rights. This is a security measure to ensure that your European Personal Information is not disclosed to a person who does not have a right to receive it.
